TERMS OF SERVICE

1. ACCEPTANCE OF TERMS

By accessing or using Ojify ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, please discontinue use. These terms are governed by the laws of the Federal Republic of Nigeria, including the Companies and Allied Matters Act (CAMA) 2020.

2. ABOUT OJIFY

Ojify is a multi-vendor e-commerce marketplace connecting local vendors with customers in Lagos, Nigeria. We facilitate transactions but individual vendors are responsible for the products they sell. Ojify operates as a registered business under CAMA 2020.

3. USER RESPONSIBILITIES

  • • Provide accurate and complete registration information
  • • Maintain the confidentiality of your account credentials
  • • Not engage in fraudulent activities or misrepresentation
  • • Comply with all applicable Nigerian laws and regulations
  • • Respect intellectual property rights of vendors and Ojify
  • • You must be at least 18 years old or have parental consent

4. VENDOR RESPONSIBILITIES

  • • Provide accurate product descriptions and pricing
  • • Comply with FCCPC (Federal Competition & Consumer Protection Commission) regulations
  • • Fulfill orders within stated timelines
  • • Honor the Ojify refund and return policy
  • • Maintain valid business registration where applicable

5. PAYMENTS & TRANSACTIONS

All payments are processed through Paystack, a CBN-licensed payment processor, via bank transfer or USSD. Ojify does not store your card or bank details. Prices are displayed in Nigerian Naira (₦). Delivery fees are calculated separately and shown at checkout.

5B. RETURNS & REFUNDS POLICY

  • • Orders cannot be cancelled. Once placed, an order will be fulfilled and delivered.
  • • Customers have 24 hours after delivery to report any issue with an order.
  • • Return requests must include clear photo evidence of the product and packaging.
  • • Valid return reasons: damaged item, wrong item, defective product, missing parts, incorrect size, or incomplete order.
  • • "Changed my mind" returns are subject to review; item must be unopened.
  • • Perishable and food items are not eligible for returns.
  • • Once approved, a pickup is scheduled the same day. Customers may receive a replacement, refund (1–3 business days to bank), or coupon credit.
  • • Vendor payments are processed 48 hours after delivery, provided no active return dispute exists.
  • • Excessive or fraudulent return activity (e.g., more than 3 returns in 30 days or a return rate above 20%) may result in return restrictions or account suspension.

6. CONSUMER PROTECTION (FCCPC)

In accordance with the Federal Competition and Consumer Protection Act 2018, customers have the right to: accurate product information, fair pricing, refunds for defective products, and file complaints with the FCCPC if disputes are unresolved.

7. DATA PROTECTION (NDPA)

We comply with the Nigeria Data Protection Act 2023 (NDPA). See our Data Protection Policy and Privacy Policy for details on how we handle your data.

8. LIMITATION OF LIABILITY

Ojify acts as a marketplace facilitator. We are not liable for indirect, incidental, or consequential damages from your use of the platform or vendor products. Liability is limited to the amount paid for the specific transaction in dispute.

9. DISPUTE RESOLUTION

Disputes shall first be resolved through our internal resolution process. If unresolved, parties may seek mediation or arbitration in Lagos, Nigeria. You also have recourse through the FCCPC.

10. CHANGES TO TERMS

We may update these terms from time to time. Continued use of Ojify after changes constitutes acceptance. We will notify users of material changes via email or in-app notification.
